Judgment
Court No. - 81 Case :- HABEAS CORPUS WRIT PETITION No. - 869 of 2023 Petitioner :- Preeti And Another Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Digvijay Singh,Sudhir Kumar Singh Counsel for Respondent :- G.A. Hon'ble Mrs. Jyotsna Sharma,J.
¶1Heard Sri Digvijay Singh, learned counsel for the petitioners and Sri L.D. Rajbhar, learned AGA for the State.
¶2Admittedly, a case crime no. 0214 of 2021 under section 366 IPC was lodged by the petitioner no. 2-Smt. Pushpa Devi (mother of the corpus) regarding abduction/disappearance of her daughter.
¶3On the instructions received by learned AGA, it comes to light that petitioner no. 1-Preeti (corpus) was recovered. Her statements under sections 161 and 164 Cr.P.C. were recorded, wherein she said that she is 'major', aged about 21 years and had willingly married respondent no. 4-Ankit and they are staying as husband and wife. In medical examination, she was found above 18 years. On her desire to accompany the respondents i.e., her in-laws, she was allowed to go with them. The copy of instructions alongwith photocopy of the statements under section 164 Cr.P.C., are taken on record.
¶4In view of the above, I do not find any good reason to entertain this habeas corpus writ petition, hence it is dismissed. Order Date :- 12.10.2023 #Vikram/- High Court of Judicature at Allahabad
