¶1The instant petition has been filed praying for a writ of mandamus commanding the respondents to settle the remaining land with petitioners to the extent of their share in the interest of justice.

¶2The petitioners admit that their land was acquired by the respondents under the provisions of the Land Acquisition Act, 1894. An award was also made and possession of the land was taken by the respondents. The petitioners admit that the respondents have constructed police-line over the acquired land, it being the object of acquisition.

¶3However, the case of the petitioners is that some part of the land including land of the petitioners, is still lying vacant and should therefore, be returned to the petitioners. It is alleged that the petitioners have not withdrawn the compensation, so they are entitled to return of the land.

¶4Learned counsel for the petitioners on being asked as to under which provision of law, such request is being made, he accepts that there is no such provision.

¶5At this stage, learned counsel for the petitioners prays for withdrawal of the writ petition.
