Judgment

Court No. - 73 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 9852 of 2023 Applicant :- Vishal Saini Opposite Party :- State of U.P. Counsel for Applicant :- Anil Kumar Mishra Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. At the very outset it appears from the perusal of the record that earlier anticipatory bail application was granted to the present applicant till submission of the police report under Section 173(2) Cr.P.C. in Cr. Misc. Anticipatory Bail Application U/S 438 CR.P.C. No. - 15149 of 2021 by order dated 7.10.2021. Subsequently after submission of charge sheet another anticipatory bail application Cr. Misc. Anticipatory Bail Application U/S 438 CR.P.C. No. - 6444 of 2023 was moved, which was disposed of on merits by this Court vide order dated 1.6.2023 and now third anticipatory bail application has been moved on the ground that co-accused Rohit @ Dhanendra has been granted anticipatory bail by this Court. I do not find it a ground to entertain this third anticipatory bail application moved by the applicant while the second anticipatory bail application has already been disposed of on merits. In the facts and circumstances of the case, there is no need to proceed further in the matter. Accordingly, this application is disposed of.
