The grievance of the petitioner in the present petition is that respondent no. 7 has illegally encroached over Plot No. 2482M situated in Village and Post Hariharpur, Tehsil Kerakat, District Jaunpur which the petitioner claims to be his bhumidhari plot. It appears that the plot has been recorded as abadi in the revenue records. The petitioner claims it to be a private abadi and also claims possession on the basis of a lease allotted to him. The issue in the present petition does not involve any issue of public law. The petitioner has the remedy to institute appropriate proceedings for either declaration of his rights or for injunction before the appropriate court.
