The present transfer application has been filed to transfer the Complaint Case No. 0900233 of 2016, Chedi Lal Vs. Smt. Reeta Rai), under Section 138 of Negotiable Instrument Act, pending in the Court of Chief Judicial Magistrate, Jalaun at Orai to any other competent court District Judgeship Allahabad. Learned counsel for the applicant submits that applicant is accused in the above noted case. It is further submitted that the other co-accused persons have not been impleaded as a party in the present transfer application. It is further submitted that the opposite party no. 2 on 24.07.2023 committed marpeet with her. In this regard she made a complaint before the S.P. Jalaun and on 26.06.2023 the opposite party no. 2 and other again committed marpeet with her. In view of the above facts and circumstances of the case, the present transfer application has no merit and deserves to be dismissed. The present transfer application is dismissed accordingly.
