Hon'ble Manoj Bajaj,J. This writ petition has been filed with a prayer that truck no. UP 62 T 5777 be released and the petitioner be permitted to pay Rs. 5,42,017.07/- in easy instalment. Sri Amit Shukla, learned counsel appearing for the respondent no. 2 has submitted that the possession of the truck was taken way back on 26.05.2023 and the auction of the vehicle was also done thereafter on 17.06.2023. He further submits that now when a third party right had been created, this Court may not interfere in the matter. We do find substance in the submission of Sri Amit Shukla, learned counsel for the respondent no. 2. Since now a third party right had been created, no interference is warranted.
