The present transfer application has been filed to transfer the Criminal Case No. 503 of 2017, (State Vs. Om Dutt Tyagi and another) under Sections 420, 467, 468, 471, 504 of I.P.C. pending in the Court Additional Civil Judge, (Junior Division)-II, Gautam Buddh Nagar to any other adjoining district. Learned counsel for the applicant submits that the applicants are accused in the above noted case. It is further submitted that on

28.09.2023, the applicant no. 1 has moved an application before the trial court regarding threatening of 40-50 local persons including the opposite party no. 2, regarding restraining the applicants from appearing before the trial court. It is fairly admits that no first information report was lodged in the said incident and the case is pending since 2017 and no other incident has taken place with regard to alleged threat. In view of the above facts and circumstances of the case, the present transfer application has no merit and deserves to be dismissed. The present transfer application is dismissed accordingly.
