¶1The instant petition has been filed praying for writ of mandamus commanding the respondents to initiate proceedings under the Land Acquisition Act, 1894 for acquiring the land of the petitioner for constructing over-bridge at Varanasi Prayagraj Railkhand and to provide compensation to him. The petitioner has also prayed for a direction to respondent no.2 to decide his representation dated

29.8.2023.

¶2The instructions received from the State-respondents by Sri Rajiv Gupta, learned Additional Chief Standing Counsel, has been placed on record.

¶3The stand taken by the State-respondents is that they are in process of identifying the land, which would be used for constructing the over-bridge. All affected persons would be paid compensation after the process of identification is over. It is also stated that at present no construction is being raised over Arazi No. 19, in respect of which the instant petition has been filed.

¶4Having regard to the aforesaid stand of the State-respondents, we are of the opinion that no further direction is required to be issued in the instant case. The State-respondents shall abide by the stand taken by them before this Court.
