¶1Heard Shri Anand Kumar Pandey, learned counsel for the petitioners and learned Standing Counsel for the State-respondents and perused the record.
¶2The grievance of the writ petitioners is that though their Institution fulfills the necessary requirements for its inclusion on the grant-in-aid list of the State Government, no decision has been taken by the Government despite application dated 16.01.2023.
¶3I have perused the said application, if it has actually been submitted by the petitioners. The application states that decision be taken as per the existing policy.
¶4Learned Standing Counsel has placed before this Court a copy of order dated 27.09.2023 passed in bunch of writ petitions connected with Writ C No. 13107 of 2023 (C/M Smt. Shivkali Devi Prathmik Vidyalaya vs State of U.P. and 4 others), in which not only the policies of grant-in-aid, but also recognition were taken into consideration with special reference to the policy dated 26.09.2023.
¶5Considering the facts of the case, the writ petition is disposed of permitting the petitioner to move a fresh application before the Government requesting inclusion on the grant-in-aid list.
¶6In case, such an application is filed along with certified copy of this order within a period of one month from today, along with necessary documents, the Government shall proceed to consider the same in accordance with law and existing policy(ies) and shall pass a reasoned and speaking order in the case of the petitioner on its own merits on or before 31.03.2024.
