¶1This is the third bail application. First two bail applications were rejected vide orders dated 29.11.2021 and 30.5.2023 respectively.

¶2Heard Sri V. P.Srivastava, learned Senior Counsel assisted by Sri Prateek Kumar Srivastava, learned counsel for the applicant, Sri Ashish Kumar Ojha, learned Brief Holder, Ms. Seema Pandey, learned counsel for complainant and perused the record.

¶3The applicant has approached this Court by way of filing the present Criminal Misc. Bail Application seeking enlargement on bail in Case Crime No.222 of 2020, under Sections 376, 313 and 506 I.P.C., Police Station-Walterganj, District-Basti.

¶4Learned Senior Counsel appearing for the applicant submitted that trial is at the stage of argument. He also pointed out that revision petition challenging the order passed in an application under Section 319 Cr.P.C. is pending before this Court at the instance of complainant. However, there is no interim order and he prayed that this application be disposed of with observation that Trial Court will hear the arguments finally.

¶5Learned Senior Counsel undertakes that applicant will not take any adjournment on the date fixed for argument.

¶6Considering the above fair submission, this third bail application is disposed of with direction to Trial Court that it will hear the arguments finally and conclude the trial expeditiously within a shortest period of time. Order Date :- 12.10.2023 SB High Court of Judicature at Allahabad
