Judgment
Court No. - 66 Case :- CRIMINAL MISC. BAIL CANCELLATION APPLICATION No. - 265 of 2021 Applicant :- Shiv Kumar Opposite Party :- State of U.P. and Another Counsel for Applicant :- Ayank Mishra Counsel for Opposite Party :- G.A.,Jitendra Rana Hon'ble Ajay Bhanot,J. Matter is taken up in the revised call. None appears on behalf of the applicant to press the bail cancellation application. Name of counsel for the applicant is shown in the cause list. This is a bail cancellation application. There are two grounds which have been taken for cancellation of bail application. Firstly, the order does not consider the facts and circumstances of the case. I am afraid the ground is misconceived. The order granting bail is backed by reasons and is a speaking order. The second ground is that the criminal history of the accused has not been disclosed in the bail cancellation application. The aforesaid allegation is bald and lacks material particulars. The bail cancellation application is essentially an application for rehearing or review of the order granting bail. Attention is called to the grounds in the application which affirm these facts. This Court is neither sitting in appeal nor in review jurisdiction. No case for bail cancellation is made out. The bail cancellation application is dismissed.
