Shri Ramesh Kumar Mishra, learned counsel for the applicant, Shri Moti Lal, learned A.G.A. for the State and Shri Jitendra Kumar Shukla, learned counsel for the opposite party No. 2 are present. Present Transfer Application has been filed to transfer the Criminal Case No. 30 of 2016 (State Vs. Sandeep Sharma and others) arising out of Case Crime No. 674 of 2013, under Sections 323, 504, 506, IPC, Police Station Dhoomanganj, District Allahabad, pending in the court of Additional Chief Judicial Magistrate, Court No. 9, Allahabad to any other competent court of District Judgeship Chandauli. Learned counsel for the applicant submits that the applicant is daughter-in-law of the opposite party No. 2. It is further submitted that the first information report of the above noted case was lodged against the brothers and friends of the applicant, who are not made party to this present Transfer Application. Learned counsel for the applicant fairly admits that three fact witnesses have been examined. In view of the above facts and circumstances, the Transfer Application has no merit and deserves to be dismissed. The instant application is dismissed accordingly. Order Date :- 12.10.2023 T.
