Judgment

Court No. - 34 Case :- WRIT - A No. - 15439 of 2023 Petitioner :- Ravi Prakash Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Suresh Bahadur,Nagendra Kumar Counsel for Respondent :- C.S.C,M.N. Singh Hon'ble Ajit Kumar,J. Petitioner, who had applied for Veterinary Medical Officer under the advertisement No. 01/2020-21 (Department No. S-02/02) dated

15.12.2021, now wants to change his category. Learned counsel for the Public Service Commission submits that once the application got filled up asking reservation in a particular category the same cannot be permitted to be changed. He has drawn the attention of the Court towards the advertisement, copy of which has been placed before the Court, of which clause 5 shows that after receipt of application any request for change in category will not be entertained. It is also submitted by learned counsel for the Public Service Commission that while participating in the interview he had given an undertaking that he would be submitting certificate of EWS category for which he had filled up the form. However, he could not submit the same within the prescribed period of 60 days. Petitioner since himself had given undertaking before the Public Service Commission that he would be furnishing the certificate, non furnishing of the same would render his declaration in the application form to be false as well. Having heard learned counsel for the respective parties and having perused the record and the advertisement, I find that the petitioner not only allowed his application to be entertained by the respondents but even got an admit card issued in EWS category and participated in the selection process. He submitted to the conditions prescribed for under the advertisement voluntarily and consciously. In the circumstances, no he cannot be permitted to change his category. Petition lacks merit and is accordingly dismissed. Order Date :- 13.10.2023/IrfanUddin High Court of Judicature at Allahabad
