¶1Heard Sri Gaurav Bhatia holding brief of Sri Dinesh Kumar Yadav, learned counsel for the petitioner and learned A.G.A. appearing for the State respondents.

¶2Present petition has been filed for quashing the First Information Report dated 11.8.2023 registered as Case Crime No. 358 of 2023, under Sections 376, 452, 506 IPC, Police Station Mehnagar, District Azamgarh. Further prayer has been made not arrest the petitioner.

¶3At the very outset, learned counsel for the petitioner submits that the petitioner has already been arrested, therefore, present petition may be dismissed as infructuous.
