¶1Supplementary affidavit filed on behalf of petitioner in the Court today is taken on record.

¶2Heard learned Counsel for the petitioner and learned Standing Counsel for the State.

¶3The instant writ petition has been filed praying for a mandamus directing the respondent No.2, Commissioner, Gorakhpur Region, district-Gorakhpur to decide the stay application filed in Appeal No. 20230500001023 within a stipulated period.

¶4Learned Counsel for the petitioner submitted that the aforesaid application is pending since 21.7.2023 before respondent no.2 for adjudication. He prayed that the same may be decided expeditiously.

¶5Perused the order-sheet, though the dates have been fixed but some reasons the order could not be passed.

¶6No useful purpose would be served in keeping this petition pending.

¶7Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to the respondent No.2, Commissioner, Gorakhpur Region, district-Gorakhpur to consider and decide the aforementioned case in accordance with law expeditiously, preferably within a period of six months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
