Judgment

Court No. - 45 Case :- CRIMINAL MISC. WRIT PETITION No. - 14774 of 2023 Petitioner :- Rajwati And 3 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Santosh Kumar Rai,Gyan Prakash Mishra Counsel for Respondent :- G.A. Hon'ble Vivek Kumar Birla,J. Hon'ble Vinod Diwakar,J.

¶1Heard Sri Santosh Kumar Rai, learned counsel for the petitioners and learned A.G.A. appearing for the State respondents.

¶2Present petition has been filed with the following prayers:- "i) issue a writ, order or direction in the nature of mandamus directing and commanding the respondents to initiate the legal proceedings permissible as per law as well as to take appropriate action against the liable police persons.

ii) issue a writ, order or direction in the nature of mandamus also to perform the medical of the injured children of the petitioners."

¶3Admitted position is that in the course of investigation of an offence allegedly committed the petitioners are being touched upon by the police.

¶4We find that the prayer is highly misconceived and vague in nature. We do not find any merit in such claim. Present petition is accordingly dismissed.

¶5However, liberty is being granted to the petitioners to avail the remedy as may be available to them in accordance with law. Order Date :- 13.10.2023 Lalit Shukla High Court of Judicature at Allahabad
