¶1Heard learned Counsel for the petitioners and learned Standing Counsel for the State.

¶2The present petition has been filed for issuance of a direction to the respondents to execute the order dated 31.12.2021 passed by respondent no.2, Sub Divisional Magistrate, Compierganj, District-Gorakhpur in proceedings under Section 41 of U.P. Land Revenue Act.

¶3A preliminary objection has been raised by learned Standing Counsel that in view of judgment of Division Bench of this Court in Writ C No.7863 of 2018 (Brij Bhushan Rai Vs. State of U.P. and 6 others), the instant writ petition is not maintainable for execution of the order passed by the revenue court.
