¶1Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

¶2Learned counsel for applicant prays for and is permitted to carry out necessary correction in the prayer of the application during the course of the day.

¶3This application under Section 482 Cr.P.C. has been filed seeking stay of further proceeding in FR Case No. 78/2016, under section 409 IPC, arising out of Case Crime No. 577 of 2015, P.S.- Jalesar, District-Etah, pending before Additional Chief Judicial Magistrate, Jalesar, Etah on the protest petition filed by respondent No. 4.

¶4After some argument, learned counsel for applicant submitted that direction may be issued for earlier disposal of FR Case No. 78/2016, under section 409 IPC, arising out of Case Crime No. 577 of 2015.

¶5Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the Trial court to decide the FR Case No. 78/2016, under section 409 IPC, arising out of Case Crime No. 577 of 2015 in accordance with law, without granting any unnecessary adjournments to either of the parties, maximum within a period of six months from the date of production of a certified copy of this order, if there is no other legal impediment. In case adjournment is granted, Court shall record detailed reasons for the same and adjournment shall not be granted by one line order.
