This writ petition has been filed against the provisional notice dated 27th June, 2023 and the recovery certificate dated 28.08.2023. Learned counsel for the petitioner states that till such time as the final assessment order is passed, no recovery can be done. Sri Pranjal Mehrotra, learned counsel for the Electricity Department concedes to this argument of the petitioner that till such time as the final assessment order is passed, no recovery could have been done. He, however, states that the petitioner may approach the respondents and submit his reply. Under such circumstances, we direct that the petitioner may approach the respondent Electricity Department and submits his reply within the next 15 days. Needless to mention that the petitioner would also be given a personal hearing. After hearing the petitioner the final assessment order shall be passed. Since we have directed that the final assessment order be passed, the recovery certificate dated 27th June, 2023 is quashed. Writ petition is partly allowed.
