¶1The prayer made in the instant petition is for a mandamus restraining the respondents from constructing the road over Gata Nos. 458, 1538-A, 447 and 1544 situated at village Kaimaha Tehsil and District Mahoba until adequate compensation is paid to the petitioners.

¶2The case of the petitioners is that the respondents are constructing a road over the aforesaid plots which belong to them without any formal acquisition and payment of compensation.

¶3Shri Rajiv Gupta, learned Additional Chief Standing Counsel submits that the claim of the petitioners has to be decided by the Committee in terms of the Government Order dated 12 May 2016.

¶4Accordingly, without expressing any opinion on merit, the writ petition is disposed of with liberty to the petitioners to file representation along with true attested copy of the instant order before respondent No. 2 within two weeks from today. Respondent No. 2 will place the representation before the Committee for being decided in accordance with law within next twelve weeks after proper survey and opportunity of hearing to the petitioners.
