¶1Heard learned Counsel for the parties and perused the record.

¶2The present petition has been filed against the order dated

01.10.2023 passed by respondent no.2, Sub Divisional Magistrate, Narwal, Kanpur Nagar dismissing the Appeal No.265 of 2020 (Nishar Khan Vs. Mumtaj), a restoration application has been filed by a Maharana Pratap Education Centre, Kanpur Nagar and the same has been allowed by the order dated 5.2.2021.

¶3Contention of learned Counsel for the petitioner is that after the restoration of the appeal, the same has yet not been decided.

¶4No useful purpose would be served in keeping this petition pending.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to the respondent No.2, Sub Divisional Magistrate, Narwal, Kanpur Nagar to consider and decide the aforementioned appeal in accordance with law within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
