¶1Heard Sri Sanjay Kr. Srivastava, learned counsel for the applicants, Sri Saroj Giri, learned counsel for opposite party no.2 and Sri Rajeev Kumar Singh, learned A.G.A. for the State.

¶2The present application has been filed for quashing of the proceeding of Case No.594 of 2023 (State Vs. Ganesh @ Galle & Others), Case Crime No.159 of 2022, u/s 7/8 of Protection of Children from Sexual Offences Act, 2012, Police Station-Zigna, District-Mirzapur, pending in the court of learned Special Judge (POCSO Act)/Addl. Sessions Judge, Mirzapur, arising out of the chargesheet dated 29.03.2023 (date of dispatch as 17.1.2023) and order of cognizance dated 26.6.2023.

¶3Learned counsel for the applicants, at the very outset, submits that the applicants want to surrender and apply for bail, therefore, necessary directions may be issued for expeditious disposal of their bail application.

¶4Considering the aforesaid submission, the present application is disposed of with a direction that if the applicants surrender and move an application for bail before the court below within 15 days from today, then their application shall be considered in view of the law laid down in Satendra Kumar Antil vs. Central Bureau of Investigation and Another, (2021) 10 SCC 773.
