¶1Instruction dated 25.08.2023 filed by learned Standing Counsel for the State-respondents is taken on record.

¶2The instant petition has been filed for the mandamus directing respondent No.2/District-Magistrate, Chandauli to decide the representation dated 26.11.2022, which has been annexed as Annexure No.5 to the writ petition.

¶3The perusal of the representation reveals that civil suit No.593 of 2022 is pending in respect to the plot in question as well as other proceedings are also pending before the appropriate forum. The perusal of the instruction dated 25.08.2023 filed by the State also revels that one case under Section 38 (2) of the U.P. Revenue Code, 2006 is also stated to be pending in respect to the plot in question at the instance of the petitioner (Lalit Vishawakarma). Particular of the case is as follows:
