Judgment

Court No. - 6 Case :- WRIT - C No. - 35512 of 2023 Petitioner :- Rambhool Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Lokesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Prashant Kumar,J.

¶1Heard Sri Lokesh Kumar, learned Counsel for the petitioner, learned Standing Counsel for the State respondents and perused the record.

¶2The instant writ petition under Article 226 of the Constitution of India has been filed for direction to the respondent no.2, District Magistrate, Meerut to grant license of Pistol/Revolver to the petitioner.

¶3Learned counsel for the petitioner states that the petitioner is an Ex-Army personnel and he has applied for a firearm license of Pistol/Revolver, but his application has been rejected by the District Magistrate on the ground that he is already having a license of Rifle. The petitioner submits that if he gets the license, applied by him, he can also get the job of P.S.O. (Private Security Officer). His request for grant of license was rejected on the ground that he already has a license of Rifle. Having a license cannot be a ground for rejection of another license as he need it for a special purpose of getting a job as a P.S.O.

¶4Learned Standing Counsel states that no useful purpose will be served in calling for the counter affidavit and keeping the writ petition as he has no objection in case, a direction is issued to the competent authority to consider the grievance of the petitioner afresh.

¶5Considering the facts and circumstances of the case, without going into its merit and with the consent of the parties, the writ petition is disposed of asking the petitioner to move a fresh application before the District Magistrate concerned ventilating his grievance. In case, any such application is filed, the District Magistrate, who is authority competent shall decide the same expeditiously, in accordance with law, keeping in mind that the petitioner is an Ex-Army personnel, preferably within a period of four weeks from the date of production of a certified copy of this order.
