¶1Heard Shri Mahendra Tripathi, learned counsel for the applicant and Shri Kamlesh Kumar Tripathi, learned AGA for the State.

¶2The instant application has been filed seeking quashing the impugned order dated 08.06.2023 passed by Additional Principal Judge, Family Court No. 1, Agra in Interim Maintenance Application dated 13.10.2022 in Case No. 917 of 2016 (Smt. Geeta Devi and another Vs. Satyabhan Singh) under section 125 Cr.P.C., P.S. Khandauli, District Agra whereby the learned Family Court has awarded interim maintenance of Rs. 3,000/- per month to the opposite party no. 2 i.e. wife and Rs. 2,000/- per month to the opposite party no. 3 i.e. minor daughter since the date of filing of interim maintenance application dated 13.10.2022.

¶3From the records it is apparent that the said application for maintenance u/s 125 Cr.P.C. is pending since 2016 as Case No. 917 of 2016 which has been subsequently converted as Case No. 817 of 2020 and seven years have been passed when the said application could not be decided, the application was moved by opposite party no. 2 claiming interim maintenance before learned Family Court.

¶4In view of the above, this Court does not find any illegality in the impugned order dated 08.06.2023 , hence the instant application is devoid of merits and is accordingly dismissed. Order Date :- 13.10.2023/Arti High Court of Judicature at Allahabad
