Judgment
Court No. - 45 Case :- CRIMINAL MISC. WRIT PETITION No. - 15660 of 2023 Petitioner :- Zahid Ahmad Siddiqui Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Mohd Naushad,Syed Irfan Ali Counsel for Respondent :- G.A. Hon'ble Vivek Kumar Birla,J. Hon'ble Vinod Diwakar,J.
¶1Heard Sri Syed Irfan Ali, learned counsel for the petitioner and learned A.G.A for the State respondents.
¶2The relief sought in this petition is for quashing of the F.I.R. dated 21.8.2023, registered as Case Crime No. 0218 of 2023, under Sections 3/5A/8 Prevention of Cow Slaughter Act, Police Station Zamaniya, District Ghazipur. Further prayer has been made not to arrest the petitioner in the aforesaid case.
¶3Submission of learned counsel for the petitioner is that the petitioner was not arrested on the spot. The accused persons arrested on the spot have taken the name of the present petitioner and present FIR lodged against the petitioner is absolutely malafide and has been lodged due to political rivalry as well as rivalry with the accused persons, therefore, it is prayed that as the petitioner has been falsely implicated in the present case, the FIR against the petitioner be quashed.
¶4Per contra, learned AGA submits that false argument has been raised by the learned counsel for the petitioner and the FIR is not liable to quashed as the accused persons arrested on the spot have specifically stated his name in the alleged offence.
¶5We find no substance in the argument raised by the learned counsel for the petitioner. Therefore, the writ petition stands dismissed. Order Date :- 13.10.2023 S.K.S. High Court of Judicature at Allahabad
