Judgment
Court No. - 10 Case :- WRIT - C No. - 35470 of 2023 Petitioner :- Mukesh Kumar Yadav Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Sheshmani Vishwakarma Counsel for Respondent :- C.S.C. Hon'ble Kshitij Shailendra,J.
¶1Heard Sri B.D. Pandey, holding brief of Sri Sheshmani Vishwakarma, learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
¶2The grievance of the petitioner is that though in the Transfer Certificate issued by an Institution run by Basic Education Board, his date of birth is recorded as 10.05.1996 and the same date is mentioned in Transfer Certificate as well as in the Certificate of Intermediate Examination passed in 2013, however, in the High School Certificate, different date of birth i.e. 08.7.1995 is entered.
¶3The petitioner claims to have submitted an application dated
22.07.2013 before the Principal of the Institution and it appears that certain verification was done at that time and there is a recommendation of the District Inspector of Schools for correction of date of birth.
¶4I find that the authorities had forwarded the matter to the Regional Secretary of the Board.
¶5It is contended that no decision has been taken by the Board.
¶6Learned Standing Counsel submits that the claim of the petitioner is highly barred by limitation as provided under Chapter III Rule 7 of Regulations framed under U.P. Intermediate Education Act, 1921 by which such correction can be made within three years.
¶7Be that as it may, in the case the Board has received the application within the period of limitation prevailing at that time, it shall proceed to the aforesaid application and shall take a decision in the matter within a period of three months from the date a certified copy of this order is produced before the Board along with necessary documents.
¶8The petition stands disposed of. Order Date :- 13.10.2023 AKShukla/- High Court of Judicature at Allahabad
