¶1Heard learned counsel for the petitioners; Shri Sharad Chandra Upadhyay, learned Standing Counsel; Shri Surya Bhan Singh, learned counsel for respondent nos.2 and 4 and Shri D.K. Singh holding brief of Shri Prateek Rai, learned counsel for the respondents.

¶2Present writ petition has been preferred for a direction to respondents to execute the agreement for "Operation and Management" of the Water Sports Complex at Ramgarh Taal, Gorakhpur in pursuance of the letter of Award of Contract dated

28.12.2021 as well as in pursuance of the letters dated 3.4.2023,

5.4.2023 and 26.4.2023 of the respondents.

¶3On the matter being taken up today, learned counsel for the petitioner, on the instructions, has stated that the tender in question has already been cancelled and as such the relief claimed in the writ petition no more survives.
