¶1Heard Sri Mahabir Yadav, learned counsel for petitioner and learned Standing counsel for State respondents and Mr. M. Asif, learned counsel for respondent no. 5.

¶2Present petition has been filed seeking following reliefs: "I. Issue a writ, order or direction in the nature of mandamus commanding the respondents no. 2 to 4 to remove the illegal encroachment and belonging to P.W.D in revenue record, and encroached the same by respondent no. 5 by making a Temple and its Verandah, due to said illegal encroachment the petitioner not properly reached on his Bhumidhari land arazi no. 918 area

0.9560 Hectare adjacent to Goverdhan, Mathura Road situated in village Adeeg, Tehsil Goverdhan, District Mathura."

¶3At the very outset, learned Standing counsel came up with specific instructions which is taken on record through which it transpired that the encroachment whatsoever was done by respondent no. 5 over the plot in dispute has already been removed by the revenue authorities and petitioner is also satisfied with the same.

¶4In view of the aforesaid, grievance of petitioner has already been redressed and no cause of action further survives for petitioner to further pursue the instant petition and the same stands disposed of. Order Date :- 13.10.2023 Shaswat High Court of Judicature at Allahabad
