The present application has been filed for quashing of the charge sheet dated 19.2.2016 arising out of Case Crime No. 140 of 2015, u/s 354 I.P.C. and 3(1)(XI) SC/ST Act, P.S. Phephana, District Ballia as well as entire proceeding arising out of Case No. 1095 of 2015 (State vs. Laxman Kanu), pending before A.C.J.M., Ballia. Learned counsel for the applicant submits that the applicant wants to surrender and apply for bail, therefore, necessary directions may be issued for expeditious disposal of his bail application. Considering the aforesaid submission, the present application is disposed of with a direction that if the applicant surrenders and moves an application for bail before the court below within 15 days from today, then his application shall be considered in view of the law laid down in Satendra Kumar Antil vs. Central Bureau of Investigation and Another, (2021) 10 SCC 773. For a period of three weeks or till disposal of the bail application, whichever is earlier, no coercive action shall be taken against the applicant.
