¶1Heard Sri Ravi Pandey, learned counsel for the applicant and Sri Brijesh Kumar Dwivedi, learned AGA for the State.

¶2The present 482 Cr.P.C. application has been filed to quash the order dated 11.07.2023 passed by Special Judge (Gangster)/Additional Sessions Judge, Court No.4, Aligarh in Session Trial No.1464 of 2023, State Vs. Kumnal Thakur @ K.D. and others, arising out of Case Crime No.1221/2022, under Section-2/3 Gangster Act, Police Station-Quarsi, District-Aligarh.

¶3Contention of learned counsel for the applicant is that applicant moved an application on 04.07.2023 for discharge in case crime no.1221 of 2022, u/s-2/3 Gangsters Act, Police Station-Quarsi, District-Aligarh. Though, court below invited objection on the aforesaid application but no order was passed in that application and directly framed charges against the applicant along with other accused on 11.07.2023.

¶4In view of the above, the present application is disposed of and if the application for discharge of the applicant has not been decided then same shall be decided, within a period of one month and till decision of that discharge application, no coercive action shall be taken against the applicant.
