Judgment
Court No. - 1 Case :- MATTERS UNDER ARTICLE 227 No. - 8520 of 2023 Petitioner :- Mrs. Sunita Devi Respondent :- Dileep Counsel for Petitioner :- Chandra Kumar Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner. This petition n has been filed seeking the following relief: "(i) direct the respondent no.1 to decide the objections ( 4Ga) dated
23.3.2022 within a stipulated time.(Annexure No. 1 to the writ petition)." The defendant no.1 is a private respondent. It appears that the petitioner is opposite party no.3 in the Succession Case No. 84 of 2021 seeking a succession certificate which was filed in the court of Civil Judge (Senior Division), Room No. 18, Deoria on
13.7.2021. It appears that the application 4C that has been enclosed as Annexure no.1 to this petition is an objection filed by the plaintiff and the opposite party no.2 in the suit to allow the objection and to grant succession certificate corresponding to their right over their 2/3 part of the property of which succession certificate was applied for. Such an application 4C which is filed by the petitioner would be considered by the Court on an appropriate stage. It is not reflected whether the petitioner has applied for succession certificate. It is the opposite party no.1 who had applied for the certificate. Be that as it may, given the relief sought in this petition which is against the private plaintiff who is not required to decide the objection, this petition is wholly misconceived and is, accordingly dismissed. Registrar (Compliance) is required to send a copy of this order to the court concerned within fifteen days. Order Date :- 16.10.2023 sfa/ (Jayant Banerji, J High Court of Judicature at Allahabad
