¶1Heard learned counsel for the applicant and learned A.G.A for the State.
¶2There is allegation against the applicant in the FIR of causing dowry death of his wife.
¶3Counsel for the applicant submits that co-accused, Sanjeev Singhal, father of the applicant and father-in-law of the deceased was granted bail by this Court by the order dated 10.07.2023 by a reasoned order giving reason why the deceased had committed suicide. Co-accused, Smt. Ina, has also been enlarged on bail by this Court vide Criminal Misc. Bail Application No. 29485 of 2023.
¶4Order of co-accused, Sanjeev Singhal, is being quoted hereinbelow:- "1. Case diary has been produced by learned AGA before this Court, which is taken on record.
¶2Heard Sri Raj Kumar Kesari, learned counsel for the applicant; Smt Shaily Ganguly, learned counsel for the informant as well as the learned AGA for the State and perused the material placed on record.
¶3The instant bail application has been filed on behalf of the applicant, Sanjeev Singhal, with a prayer to release him on bail in Case Crime No. 173 of 2023, under Sections 498-A, 304-B IPC, and ¾ Dowry Prohibition Act, Police Station Garh Mukteshwar, District-Hapur, during pendency of trial.
¶4There is allegation against the applicant that he has caused dowery death of his daughter-in-law because of non-fulfillment demand of dowry.
¶5Learned counsel for the applicant has submitted that the applicant is the father-n-law of the deceased. Marriage of the deceased took place on 28th May, 2019 and thereafter, she gave birth to a male child who is mentally retarded and physically disabled and aged about 2 years. Learned counsel for the applicant has further submitted that it is a case of false implication. The deceased was under depression after she gave birth to an abnormal child. Two years ago, she consumed poison and hanged herself to death. He submitted that it is a case of suicide not murder. He has further been submitted that the deceased was under depression and was being treated at Sardar Ballabh Bhai Patel Hospital, Meerut. Earlier, co-accused, Shubham, her husband and the deceased were living separately. She was living at Meerut since April, 2020 at a place which was 500 metres her parental home. Co-accused, Shubham, was appointed in ICICI Bank at Garh Mukteshwar on
05.04.2023 and since then the deceased started living with him. The allegation of demand of dowry in cash and a car are absolutely false. The incident took place at Garh Mukteshwar, where, the applicant was not living. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 17.04.2023. The trial in the aforesaid case is not likely to be concluded in near future.
¶6Learned A.G.A. and learned counsel for informant have vehemently opposed the prayer for bail of the applicant and have submitted that the deceased died within seven years of her marriage with the son of the applicant. They further submitted that because of non-fulfillment of demand of dowry of Rs. 20 lakhs and a car, the victim was hanged to death. In case the applicant is released on bail he will again indulge in similar activities and will misuse the liberty of bail.
¶7After hearing the rival contentions, this Court finds that the cause of death of the deceased was found to be asphyxia due to combined affect of asphyxia, venous congestion due to ante-mortem hanging. It also clear from the record that the deceased was under psychiatric treatment because of depression suffered by her. Her son was clearly physically and mentally disabled and therefore, there is possibility of the deceased committing suicide by way of hanging. The applicant has no previous criminal antecedents.
¶8Having considered the submissions of the parties noted above, finding force in the submissions made by the learned counsel for the applicant, keeping in view the uncertainty regarding conclusion of trial; one sided investigation by police, ignoring the case of accused side; applicant being under-trial having fundamental right to speedy trial; larger mandate of the Article 21 of the Constitution of India, considering the dictum of Apex Court in the case of Satendra Kumar Antil Vs. C.B.I. & Another, passed in S.L.P. (Crl.)
