¶1The grievance of the petitioners in the present petition is that the respondent nos. 5 to 7 are illegally encroaching over the property of Shivji Maharaj, Ram Chandraji Maharaj and Laxmanji Maharaj Virajman Mandir situated in District Saharanpur. The petitioners pray that they may be restrained from interfering in the property of Temple.

¶2The respondent nos. 5 to 7 are private citizens and not public bodies. The issue raised in the present petition does not involve any question of public law so as to require consideration under Article 226 of the Constitution of India.

¶3The managing body of the Trust has the right to institute a suit for injunction in the appropriate civil court.

¶4The writ petition is not maintainable and is dismissed as such.
