¶1Heard Sri Pradeep Kumar, Advocate for petitioner, Sri A.K. Rai, learned Additional Chief Standing Counsel for State and Sri B.R. Sharma, learned counsel for respondents.

¶2The order passed by Deputy Commissioner (Consolidation) on transfer application is as follows -: "

¶3I find merit in argument of learned counsel for petitioner that from above referred order, it is not clear on which ground (factual or legal), the transfer application was rejected, therefore, impugned order may be set aside.

¶4Learned Standing Counsel as well as learned counsel for respondents have not able to contradict above submissions.

¶5In view of above, the impugned order dated

20.12.2022 is set aside and Director (Consolidation), Uttar Pradesh is directed to consider the application and decide the same expeditiously, if possible, within shortest time considering the provisions of Rule 65 of U.P. Consolidation of Holdings Rules, 1954.

¶6Meanwhile, Deputy Director of Consolidation has liberty to continue the proceedings of revision petition.
