¶1Heard learned counsel for the respective parties.

¶2Petitioner is aggrieved by non-consideration of his claim for promotion on account of pending entry of censure, which has been awarded to him in his character roll pursuant to the order of minor punishment passed by respondents.

¶3It is admitted to the petitioner that his claim petition against the punishment order is pending before the U.P. State Services Tribunal. In such circumstances, I do not find any justification to interfere with the order impugned. It is always there that whenever, the order of tribunal is passed, the same shall prevail. The petitioner may either apply for expeditious disposal of the pending claim petition before the concerned Bench of this Court having roster in the matter arising out of service tribunal proceedings or should approach the tribunal itself for expeditious disposal/consideration of his claim petition. He may also move appropriate application before the tribunal, if so advised, for interference at the interim stage in the process of promotion being undertaken by the respondents.
