The instant bail application has been filed on behalf of the applicant, Mahipal Saini, with a prayer to release him on bail in Case Crime No. 285 of 2019, under Sections 147, 148, 149, 452, 302, 307, 323, 504 IPC, Police Station Kotwali Nagar, District-Saharanpur, during pendency of trial. This is second bail application of the applicant. The applicant was enlarged on bail by co-ordinate Bench of this Court on 17.6.2021, which was cancelled by Apex Court on 26.11.2021. Learned counsel for the applicant has approached this Court on the ground that trial is being delayed. The applicant is in jail since

20.8.2019, hence he may be enlarged on bail. Since the Apex Court did not granted liberty to this Court to re-hear the bail application of the applicant afresh on merits, in case trial is not concluded within some fixed period of time, this bail application of the applicant is rejected.
