Court No. - 40 Case :- WRIT - C No. - 29255 of 2023 Petitioner :- Sriprakash Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Sushma Yadav,Hirdesh Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard Sri H.K. Yadav, learned counsel for the petitioner and Ms. Uttara Bahuguna, learned Additional Chief Standing Counsel for the State respondents.
¶2Learned counsel for the petitioner has confined his prayer that direction may be issued to the respondent no.2, Sub Divisional Magistrate, Sadar, Ghazipur to decide his claim of the petitioner.
¶3Considering the facts and circumstances, as the matter has traveled up to Hon'ble Apex Court, we are not inclined to entertain this writ petition. However, as the relief is only confined that the grievance of the petitioner may be redressed by the Sub Divisional Magistrate, without adverting on merits, we hope and trust that the claim of the petitioner, which is already pending before the respondent no.2, Sub Divisional Magistrate, Sadar, Ghazipur shall be concluded to its logical end but certainly after affording opportunity to all Stakeholders.
¶4With the aforesaid observation, the writ petition stands disposed of. Order Date :- 16.10.2023 S.P. High Court of Judicature at Allahabad
