¶1This case is listed peremptorily today.

¶2When the case was listed on 23.8.2023, the following order was passed: "It has been informed on behalf of the learned counsel for the petitioners that he is indisposed. As such, list this matter as fresh in the next week."

¶3Again on 27.9.2023, the following order was passed: "A request has again been made on behalf of the learned counsel for the petitioners for adjournment of the case on the ground that he is suffering both from dengue and malaria. As prayed, list this matter as fresh peremptorily in the week commencing

16.10.2023."

¶4Today, when the matter is taken up, no one appears for the petitioners to press this petition.

¶5This petition has been filed seeking the following relief: "a. Issue a suitable order or direction, granting interim injunction in favour of the plaintiffs-petitioners till the disposal of 6C application for interim injunction filed by the plaintiffs-petitioners in Original Suit No. 1724 of 2022 (Premnath @ Prem Chand and another Vs. State of U.P. and another), pending before the learned Civil Judge ( JNunior division), City, Jaunpur."

¶6It appears that the plaintiff-petitioners filed a suit against the State Government and the Gaon Sabha seeking a decree of permanent injunction with regard to their possession over Arazi No. 522M, area 30 decimal situated in Mauza Hasanpur, Pargana Kariyatdost, Tehsil Sadar, District Jaunpur. It is stated in the prayer made in this petition that till disposal of 6C application for temporary injunction, an interim injunction be granted by this Court.

¶7The certified copy of the order sheet is not enclosed and even otherwise, no case for interference is made out.
