¶1Heard Mr. Dharmendra Srivastava, learned counsel for the petitioner and Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents.

¶2The instant public interest litigation has been filed for mandamus commanding respondent no.4 i.e. Tahsildar, Tahsil-Sadar, District-Azamgarh to take steps for removal of encroachment over Khasra No.120 area 0.0510 hectare.

¶3Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents has placed the instruction dated 23.9.2023 before the Court, which is taken on record.

¶4On the basis of instruction, learned Additional Chief Standing Counsel for the State-respondents submitted that in respect to plot no.120 area 0.0510 hectare proceeding under Section 67 of U.P. Revenue Code, 2006 has been registered before the Tahsildar concerned. The particular of the case number is as follows: "T202315060100806 (Report Vs. Ashok Kumar)"

¶5In view of the facts mentioned in the instruction dated 23.9.2023, the instant public interest litigation is finally disposed of directing respondent no.4 i.e. Tahsildar, Tahsil-Sadar, District-Azamgarh to decide the aforementioned Case No.T202315060100806 (Report Vs. Ashok Kumar), under Section 67 of U.P. Revenue Code, 2006 in accordance with law after affording proper opportunity of hearing to both parties, expeditiously preferably within a period of four months from the date of production of certified copy of this order before him.
