¶1Heard learned counsel appearing for the petitioner and Sri Pranesh Dutt Tripathi, learned counsel appearing for the Respondents No. 2 & 3.

¶3Learned counsel appearing for the petitioner has submitted that at the time when similarly situated Assistant Teachers were considered for promotion on the posts of Headmaster, certain disciplinary proceedings were pending against the petitioner, therefore, he could not be granted promotion at that point of time but later on petitioner has been granted promotion w.e.f. the date when similarly situated teachers were granted promotion. It has further been submitted by the learned counsel appearing for the petitioner that though petitioner has been granted promotion w.e.f. the date when the similarly situated teachers were promoted but is being paid less salary to that of the said teachers.

¶4Learned counsel appearing for the petitioner has invited attention of this court towards the representation given by the petitioner to the District Basic Education Officer, Kushi Nagar on 20.1.2020 but decision has not been taken in the matter till date.

¶5Sri Pranesh Dutt Tripathi, learned counsel appearing for the Respondents No. 2 & 3 has very fairly submitted that once the representation has already been filed by the petitioner before the District Basic Education Officer, Kushi Nagar, his grievance can be looked into and decided by the Respondent No. 2 within a fixed time frame.

¶6In view of the aforesaid submissions advanced by the learned counsels appearing for the parties, this Writ Petition is finally disposed of with liberty to the petitioner to file a fresh representation before the District Basic Education Officer, Kushi Nagar, within fifteen days from today and if such representation is filed within the aforesaid period, the District Basic Education Officer, Kushi Nagar is directed to consider and decide the said representation within a period of two months thereafter.
