A preliminary objection has been raised by Sri R.K.singh, learned counsel for the respondent regrading maintainability of this petition as prayer made in respect of certain amount is an incidence of service, and therefore, matter is cognizable by Armed Force Tribunal constituted under Armed Forces Tribunal Act, 2007. In views of above, I decline to entertain this petition, however, liberty rests with the petitioner to approach Armed Force Tribunal, if so advised. The Writ petition is consigned to records.
