The grievance of the petitioner in the present petition is that respondent nos. 4 to 6 have encroached upon the drain constructed for irrigation purposes obstructing the flow of water to the agricultural fields of different villagers. The petitioner has the remedy to file an application under Section 26 of the U.P. Revenue Code, 2006 before the Tehsildar. The petition is disposed of with a direction that in case, the petitioner or any other villager files an application before the Tehsildar Aurai, District Bhadohi, the same shall be decided by the said Tehsildar within a period of three months from the date of filing the application. In case, any encroachment is found by the Tehsildar, the Tehsildar shall ensure the removal of said obstruction / encroachment within a period of one month from the date of his decision.
