Subsequently in her statement under Section 164 Cr.P.C. she states of co-accused Amar, the applicant Pradum and one Satpal entering the house after scaling the wall and then Satpal and applicant committed rape upon her and Amar threatening her with gun. It is argued that prosecution case is not consistent. It has also been pointed out that the applicant is not having any criminal history as stated in para 16 of the affidavit. The applicant is in jail since 21.1.2023.

¶6Per contra learned counsel for the State opposed the prayer for bail.
