Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Vinod Kumar, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. The writ petition has been filed with a prayer to direct the respondents-authorities to initiate the detail enquiry as to why recovery is being made from the petitioner in respect of deficiency/lapses caused during the functioning of respondent no.7, in respect of distributing the essential commodities amongst the villagers/card holders. Learned counsel for the petitioner submits that the respondent no.7 was running a fair price shop in village Mamoli, Tehsil Meja, District Prayagraj. There being several complaints with respect to the irregularities of distribution of essential commodities, his fair price shop license was suspended and cancelled and recovery regarding the loss as incurred is being made from the petitioner, who has been granted fair price shop license by means of fresh allotment on 05.03.2021. Learned Standing Counsel points out that the present petition has been filed in anticipation without there being any order of recovery, therefore, the petition is misconceived and is liable to be dismissed.
