¶1Heard Sri Babu Lal Ram, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking direction in the nature of mandamus commanding the respondents to take action with regard to evicting the respondent no. 6 who have illegally occupied the plot no. 143 area 0.001 hectare situated at village Ajoria Bahiari Baghel, Tehsil Bhatparrani, District Deoria which is public utility land.

¶3At the very outset, learned Standing counsel came up with specific instructions which is taken on record through which it transpired that the encroachment from the plot in question has already been removed by the encroacher himself and as such no cause of action further survives for petitioner to pursue the instant petition.

¶4In view of the aforementioned facts and circumstances, grievance of petitioner has already been redressed in pursuance to the prayer sought through the instant petition and as such the instant P.I.L stands disposed of. Order Date :- 16.10.2023 Shaswat High Court of Judicature at Allahabad
