Shri Hridai Narayan Sharma, learned counsel for the revisionist and Shri Rajech Kumar Maurya, learned A.G.A for the State are present. The present criminal revision has been preferred to set aside the judgement and order dated 10.03.2023 passed by Special Judge S.C./S.T Act, Allahabad in Criminal Misc. Application No. 19 of 2022 by which the trial court rejected the application of the revisionist under Section 156(3) Cr.P.C. Learned counsel for the revisionist submits that the revisionist filed an application under Section 156(3) Cr.P.C. against opposite party nos. 2 and 3 alleging that opposite party no. 2 is Gram Panchayat Adhikari, and opposite party no. 3 is brother of opposite party no. 2, alleging his allotment of a house has been cancelled, on the basis of the report of opposite party no. 2 due to this enmity on
28.10.2021 at about 3 PM opposite party nos. 3 and two other unknown persons entered into the house of the revisionist where his mother was present, committed marpeet with her and abused her with caste derogatory words. Learned counsel for the revisionist fairly admitted that the place of incident is not a public place or a place of public view. He fairly admitted that the revisionist complained to the SSP Prayagraj, after about one and half month of the incident and there is no medical report. In view of the above facts and circumstances, there is no illegality in the order dated 10.03.2023 and the present criminal revision has no merit and it deserves to be dismissed. Accordingly the present criminal revision is dismissed at the stage of admission. Order Date :- 13.10.2023 Saurabh High Court of Judicature at Allahabad
