¶1Instructions filed today be kept on record.

¶2The petitioners who are three in numbers had their environmental clearances from the District Authorities namely District Environmental Impact Assessment Authorities (hearinafter referred to as "DEIAA"). However, upon an order being passed by the National Green Tribunal on 7.12.2022 that all environmental clearances given by the District Environmental Impact Assessment Authorities be re-appraised by the State Environmental Impact Assessment Authorities (hereinafter referred to as "SEIAA"), the Director of Geology wrote to all the District Magistrates of Uttar Pradesh on 24.6.2023 that the environmental clearances given by the DEIAA shall now be re-appraised by SEIAA.

¶3Further the District Magistrate, Mirzapur has written to the SEIAA that the environmental clearance given by the DEIAA to the 63 units of Mirzapur be re-appraised.

¶4From the communication which has been sent on 14.10.2023 by the District Magistrate, we find that the names of the petitioners were to be found at Serial Nos.4, 6 and 7 of the list which had been sent by the District Magistrate to the State Authorities for re-appraisal of their environmental clearances.

¶5We are definitely of the view that the re-appraisal would be done by the State Authorities under the time provided by the office memorandum of the Government of India dated 28.4.2023.

¶6With these observations, the writ petition stands disposed of. Order Date :- 17.10.2023 GS (Manoj Bajaj, J.) (Siddhartha Varma, J.) High Court of Judicature at Allahabad
