¶1Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.

¶2By means of the present petition the petitioner has sought following main prayers: "(i) issue a writ, order or direction in the nature of mandamus commanding the Investigating OfÏcer, Police Station Cant, District Hapur to conduct the investigation and submit progress report with regard to F.I.R. dated 24.05.2023 lodged in Case Crime No. 0098 of 2023, under Sections 147, 148, 149, 427, 452, 307, 354, 354(Ka), 354(Kha), 323, 395, 504, 506 IPC, P.S. Dhaulana, District Hapur (Annexure no. 1 to the writ petition).

(ii) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 and 3 to arrest the accused persons in pursuant to F.I.R. dated 24.05.2023 lodged in Case Crime No. 0098 of 2023, under Sections 147, 148, 149, 427, 452, 307, 354, 354(Ka), 354(Kha), 323, 395, 504, 506 IPC, P.S. Dhaulana, District Hapur."

¶3We have perused the F.I.R., the F.I.R. is against as many as 37 named accused and 4 unnamed persons.

¶4Submission advanced by the learned counsel for the petitioner is that the petitioner is a poor lady has been running from pillar to post to get a F.I.R. lodged but of no avail. The F.I.R. is of May, 2023, under serious sections of IPC, but the concerned Investigating OfÏcer is sitting over tight the matter.

¶5Superintendent of Police, District Hapur is directed to look into the matter and pass a proper instructions to the concerned Investigating OfÏcer to gear up the investigation and submit the report under section 173(2) Cr.P.C preferably by 30th November, 2023.
