Judgment
Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 16344 of 2023 Petitioner :- Pradeep And 6 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Anil Kuamr Mishra Counsel for Respondent :- G.A. Hon'ble Anjani Kumar Mishra,J. Hon'ble Vivek Kumar Singh,J.
¶1Heard learned counsel for the petitioner and learned A.G.A. for the State.
¶2The instant writ petition seeks quashing of the FIR dated
23.09.2023 giving rise to Case Crime No. 0204 of 2023, under Section 147, 148, 149, 323, 504, 364, 392 IPC and Section 3(2)(V) S.C./S.T. Act, Police Station-Mundali, District-Meerut.
¶3The contention of the learned counsel for the petitioners is that both the parties have lodged first information reports regarding the same incident.
¶4Under the circumstances, since both the parties have lodged the first information reports, it cannot be said that either of the first information report is completely concocted. The matter, therefore, will require in depth investigation.
¶4Moreover, the allegations made in the first information report clearly disclose commission of cognizable offences and the allegations are serious in nature. Therefore, prayer of the petitioners to quash the First Information Report is completely misconceived and is rejected.
¶5The writ petition is, therefore, dismissed, without prejudice to the right of the petitioners to apply for bail/anticipatory bail. Order Date :- 17.10.2023 Himanshu High Court of Judicature at Allahabad
